Terms of Service

Welcome to Zavrah. These Terms of Service (the "Terms") are a legal agreement between you and Zavrah, Inc. ("Zavrah", "we", "us", or "our") that govern your access to and use of our websites, applications, APIs, and services (collectively, the "Service"). By creating an account or using Zavrah, you agree to these Terms. If you don't agree, don't use the Service.
1. Introduction
Zavrah is a social platform built around communities (servers), direct messages, voice and video chat, user-generated content, cosmetics, server boosts, and creator payouts. These Terms apply every time you use Zavrah, whether as a server owner, member, viewer, creator, or paying customer.
Some features have additional rules (for example, our Community Guidelines, Creator Program rules, and Refund Policy). Those rules are incorporated into these Terms by reference. Where there's a conflict, these Terms control unless the other document explicitly says otherwise.
2. Eligibility & Age
You must be at least 13 years old to use Zavrah. If you are under the age of majority in your jurisdiction (typically 18), you may only use Zavrah with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf.
If we learn that we have collected personal information from a user under 13, we will delete that account and associated data. You must not use Zavrah if you are barred from doing so under the laws of your country, or if you are on any U.S. sanctions or restricted-party list.
3. Your Account
You're responsible for everything that happens on your account. That means choosing a strong password, keeping your login credentials private, enabling two-factor authentication where available, and telling us promptly if you suspect unauthorized access.
You agree to provide accurate information when you sign up and to keep it up to date. You may not impersonate another person, create accounts to evade bans, or run more than one account in a way that violates these Terms. You may close your account at any time from your account settings.
4. User-Generated Content
Zavrah lets you post messages, images, audio, video, files, cosmetics, server descriptions, and other content ("User Content"). You keep ownership of your User Content. By posting it on Zavrah, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (e.g., resize or transcode), distribute, and display your User Content solely for the purpose of operating, providing, and improving the Service.
You are solely responsible for your User Content. Zavrah is a platform, not a publisher. We do not pre-screen, endorse, or verify User Content, and we expressly disclaim responsibility for any User Content posted by you or other users. If you rely on User Content, you do so at your own risk.
We may remove, restrict, or refuse to display any User Content for any reason, including violations of these Terms, our Community Guidelines, or applicable law. We may also preserve User Content and account information to comply with legal requests or to protect our users.
5. Prohibited Behavior
You agree not to use Zavrah to:
- Post illegal content, including child sexual abuse material (CSAM), credible threats of violence, terrorism content, or material that incites real-world harm.
- Harass, bully, threaten, stalk, dox, sexually harass, or hatefully attack any person or group.
- Share non-consensual intimate imagery, sexual content involving minors, or content that sexualizes real people without consent.
- Distribute malware, phishing links, scams, fraudulent schemes, or instructions to harm computer systems.
- Evade bans, manipulate moderation systems, abuse our reporting tools, or interfere with other users' accounts.
- Scrape, crawl, reverse engineer, or access the Service through unauthorized means, or attempt to extract source code, models, or non-public APIs.
- Spam, run unauthorized bots, send unsolicited messages, or artificially inflate metrics like boosts, views, or earnings.
- Sell, transfer, or rent your account, server ownership, cosmetics, or roles outside of features Zavrah explicitly provides.
- Use Zavrah in violation of any applicable law, including export controls and sanctions.
Violations may result in content removal, feature restrictions, suspension, permanent termination, forfeiture of cosmetics or earnings, and referral to law enforcement.
6. Bullying, Harassment & User Behavior
Zavrah is a social platform, which means real people will interact with you and other people will interact with each other. We provide tools to keep you safe — block, mute, report, content filters, server moderation, automod — but we are not responsible for the behavior of users, including bullying, harassment, threats, insults, or emotional distress caused by other users' messages or content.
To the fullest extent permitted by law, you release Zavrah from any and all claims, demands, and damages arising out of or related to disputes with other users, including harassment, defamation, doxxing, impersonation, intentional infliction of emotional distress, or any other interpersonal harm. This release does not limit Zavrah's own statutory obligations under applicable law.
If you experience or witness behavior that violates our rules, use the in-app report tools. We review reports and take action consistent with our Community Guidelines, but we cannot guarantee any specific outcome, response time, or remedy.
7. Moderation & Termination
We may, at our sole discretion and without prior notice, investigate, restrict, suspend, terminate, ban, shadowban, or rate-limit any account, server, or content that we believe violates these Terms, our Community Guidelines, or applicable law, or that creates risk or legal exposure for Zavrah or our users.
Enforcement actions may include removing content, revoking roles or cosmetics, freezing balances, withholding payouts pending investigation, terminating servers, and permanently banning users. We may also retain limited data after termination as required by law, to enforce these Terms, or to prevent abuse.
You may appeal certain enforcement actions through the in-app appeals system where available. Appeal decisions are final. We have no obligation to restore any account, server, content, cosmetic, balance, or boost after termination.
8. Server Ownership & Roles
A "server" is a community space hosted on Zavrah. The user who creates a server is its owner unless ownership is transferred through an in-app feature provided by Zavrah. Owners may grant roles and permissions to other members but remain ultimately responsible for moderating their server and ensuring it complies with these Terms.
Server ownership is a license to use Zavrah's hosting and features for that community — it is not a transferable asset and confers no ownership of Zavrah's platform, software, or infrastructure. You may not sell, auction, rent, or transfer a server, role, channel, or username for cash or other consideration outside of features Zavrah explicitly supports.
We may remove servers that repeatedly violate our rules, are abandoned, infringe trademarks, impersonate brands or people, or are used primarily to evade enforcement. We may also reclaim server names and usernames under our naming policies.
9. Cosmetics & Refunds
"Cosmetics" are digital items (such as avatars, profile effects, themes, badges, emojis, and other decorative content) you can buy or receive on Zavrah. Cosmetics are a limited, personal, non-exclusive, non-transferable, revocable license to use the cosmetic within the Service. You do not own the cosmetic, the underlying art, or any intellectual property in it.
Cosmetics have no monetary value outside the Service and cannot be exchanged for cash, traded outside Zavrah's official systems, or transferred to another account except through features we provide. We may modify, remove, or discontinue cosmetics at any time, including for reasons such as licensing changes, creator removal, or policy violations.
Refund policy. All cosmetic purchases are final once the cosmetic is delivered to your account, except where required by law. We may, at our sole discretion, issue a refund for a duplicate charge, a clearly defective cosmetic, or an unauthorized purchase reported promptly. Refund requests must be submitted within 14 days of purchase via in-app support. Refunds for cosmetics created by third-party creators may be deducted from that creator's future payouts.
If your account is suspended or terminated for violating these Terms, any cosmetics, balances, or unclaimed earnings may be forfeited without refund.
10. Server Boosts
"Boosts" are recurring or one-time purchases that unlock enhanced features for a specific server (for example, higher upload limits, additional emoji slots, or a "Server Booster" role). Boosts are tied to the server you apply them to and grant you certain perks while the boost is active.
Boost subscriptions automatically renew until cancelled. You can cancel at any time from your billing settings, and your boost will remain active through the end of the already-paid period. Except where required by law, payments for boosts are non-refundable, including if a server is terminated, abandoned, or no longer eligible for the boost benefits.
Boost benefits may change. We may add, remove, or alter the perks associated with any boost tier at any time. If we materially reduce the benefits of an active paid boost, we will use commercially reasonable efforts to provide notice or a prorated remedy.
11. Creator Payouts
Eligible creators may earn revenue from cosmetics and other monetized features ("Creator Earnings"). Unless otherwise stated, creators receive seventy percent (70%) of the net revenue from each qualifying sale, and Zavrah retains thirty percent (30%). "Net revenue" means the amount Zavrah actually receives from the payment processor for the sale, after refunds, chargebacks, payment processing fees, applicable taxes, fraud losses, and currency conversion costs.
To receive payouts you must complete identity verification (KYC), accept the Creator Program rules, provide accurate payout details, and comply with U.S. tax reporting (including IRS Forms W-9 or W-8 as applicable). Payouts are processed on the schedule published in the creator dashboard, subject to minimum payout thresholds and holding periods used to cover refunds, disputes, and fraud review.
We may withhold, freeze, claw back, or reverse Creator Earnings to cover refunds, chargebacks, fraud, violations of these Terms, suspected fraud or money laundering, or amounts we owe to third parties such as rights holders or tax authorities. Creator Earnings are not bank deposits, are not insured, and accrue no interest.
Creators warrant that they own or have all necessary rights to the cosmetics and content they submit, and grant Zavrah a worldwide, royalty-free license to host, sell, distribute, modify, promote, and remove that content. Creators are responsible for paying their own taxes on Creator Earnings.
12. DMCA & Copyright
Zavrah respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe content on Zavrah infringes your copyright, send a written notice to our designated DMCA agent that includes:
- Your physical or electronic signature (or that of the rights holder's authorized agent).
- Identification of the copyrighted work you claim has been infringed.
- Identification of the material that is allegedly infringing, including a URL or other information sufficient for us to locate it.
- Your contact information (name, address, telephone number, email).
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the rights holder.
Send DMCA notices to dmca@zavrah.com. We will respond to valid notices by removing or disabling access to the material and notifying the user who posted it. If you believe your content was removed by mistake or misidentification, you may submit a counter-notice with the information required by 17 U.S.C. § 512(g)(3).
We will terminate, in appropriate circumstances, accounts of repeat infringers. Misrepresentations in a DMCA notice or counter-notice may subject you to liability under 17 U.S.C. § 512(f).
13. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, ZAVRAH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components, that any User Content is accurate or reliable, or that any defects will be corrected. You use the Service at your own risk.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ZAVRAH, ITS AFFILIATES, OR THEIR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, USE, COSMETICS, BOOSTS, EARNINGS, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID ZAVRAH IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US$100).
Some jurisdictions don't allow the exclusion of certain warranties or limitations on certain damages. In those jurisdictions, the exclusions and limitations above apply to the fullest extent permitted by law.
15. Arbitration & Class Action Waiver
Please read this section carefully — it affects your legal rights.
You and Zavrah agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (a "Dispute") will be resolved by binding individual arbitration, and not in a court of law, except that either party may bring an individual action in small-claims court or seek injunctive relief in court for intellectual-property infringement.
The arbitration will be administered by JAMS under its Streamlined Arbitration Rules, before a single arbitrator, in the English language, seated in San Francisco County, California, unless you and we agree otherwise. The arbitrator's decision will be final and enforceable in any court of competent jurisdiction. The Federal Arbitration Act governs the interpretation and enforcement of this section.
Class Action Waiver. You and Zavrah agree to bring Disputes only in our or your individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative proceeding.
30-Day Opt-Out. You may opt out of this arbitration agreement by sending written notice to legal@zavrah.com within 30 days of first accepting these Terms, including your account email and the statement "I opt out of arbitration." Opting out will not affect any other part of these Terms.
16. Governing Law
These Terms and any Dispute are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Subject to the arbitration section above, you and Zavrah submit to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California, for any action not subject to arbitration.
17. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by email before the changes take effect. Your continued use of Zavrah after the effective date of the updated Terms constitutes acceptance of those changes. If you don't agree, you must stop using the Service.
